A ANEEL (National Electric Energy Agency) approved on Tuesday (10/12) new regulations to improve the retail sale of energy. The changes aim to simplify, make safer and more efficient the processes of migration and disconnection of agents in the market.
Reduced deadlines and greater agility
One of the main changes was the reduction of the deadline for the judgment of disconnection from the CCEE (Electric Energy Trading Chamber), which went from 60 to 30 days after the agent's default. The objective is to speed up the process.
Defaulting retail consumers will also have less time to settle their debts: the deadline has been reduced from 30 to 15 days, reducing the period of exposure for agents.
Furthermore, ANEEL determined that distributors must notify CCEE whenever there is a suspension of supply to the consumer represented by the retailer. CCEE, in turn, will notify the retailer about the suspension.
Standard contract
The retailer must make available on its portal a standard energy purchase and sale contract, valid for one year. The contract must provide for the distribution of energy volume with seasonal and flat modulation, ensuring greater transparency and uniformity in the processes.
Centralization of information
The CCEE will be responsible for centralizing all information related to retail consumer migrations. To this end, a system will be developed that allows for the addition of new future parameters and offers greater visibility to transitions to the free energy market.
Aggregation of measurement data
Distributors will be responsible for providing consumer measurement data to CCEE, which will aggregate and allocate the data to the respective retail agents. This flow will allow for greater accuracy in ing for the loads assigned to each agent.
Rules for the termination of retail traders
The termination of retail sales due to the disconnection from the CCEE was adjusted in REN No. 1.011/2022, since direct hip of the CCEE is not permitted for consumers in Group A who remain obliged to have retail representation. In the same sense, within the scope of REN No. 1.000/2021, there was an adjustment in art. 354, to include the distributor's duty to suspend the supply of all consumer units modeled on the CCEE whose representation by a retail agent has been terminated.
If the retailer is disconnected, the consumer will depend on the acceptance of another retailer or the local distributor to continue receiving energy. Regulatory treatment will follow rules similar to those applicable to free consumers whose migration processes were not completed for reasons beyond the distributor's control.
Public consultation process
All of these changes underwent public consultation ( 28/2023), which included two phases of contributions: the first between August 30 and October 13, 2023, and the second between April 24 and June 7, 2024. During the period, 238 suggestions were received from 32 agents, including generators, distributors, traders, consumer councils, associations and the CCEE itself.
With these measures, the ANEEL seeks to modernize and strengthen the dynamics of the free energy market, ensuring greater efficiency and reliability for all agents involved.
