After a legal dispute with Amazonas Energia, ANEEL (National Electric Energy Agency) unanimously decided to open a public consultation to continue the transfer of corporate control of the company. The company serves more than 1 million consumer units in the 62 municipalities of Amazonas.
The process endorses MP 1.232/2024 (Provisional Measure 1.232/2024), which was at risk of losing its validity if no action was taken by October 12.
With the decision of the board of directors of ANEEL A public consultation will be held in the form of document exchange between September 4th and 13th, to obtain subsidies and additional information to establish the necessary conditions for the transfer of corporate control of Amazonas Energia.
Last week, the Agency had already started regulating the MP, after Amazonas Energia went to the Federal Court, which granted an injunction for the process to begin.
The distributor, a former arm of Eletrobrás, was acquired by the Oliveira Energia group in 2018. Since then, it has been operating at a loss, as it has not received contributions from the Federal Government, which would be in the order of R$2 billion until 2023.
As the resources were not forthcoming, the group began to want to get rid of Amazonas Energia. The government had to issue a provisional measure, extending the amounts to the new buyer for a period of 12 years.
The Minister of Mines and Energy, Alexandre Silveira, is one of the enthusiasts of the sale of Amazonas Energia. He recently stated that there will be costs to the government and taxpayers if the transfer does not take place. The Agency, however, would not be in favor of the only purchase proposal that has emerged so far, from the J&F group.
After the public consultation authorized by ANEEL, there will be 30 days until the provisional measure expires. If nothing happens by October 12, the MP will expire, requiring the minister and the government to possibly intervene in the distributor.
