In a collegiate meeting held last Tuesday (21), the ANEEL (National Electric Energy Agency) recommended to the MME (Ministry of Mines and Energy) the termination of the distributor's concession contract Amazonas Energy, which meets 900 thousand consumer units in 62 municipalities in Amazonas.
“The penalty arises from the rejection of the request to transfer corporate control from Amazonas Energia to Green Energy Soluções em Energia, as the documentation presented does not prove the technical and economic-financial capacity of the proponent to assume the distribution concession”, justifies the electricity sector regulator.
A ANEEL fined Amazonas Energia in September 2022 for failing to comply with contractual clauses related to the management of financial resources and the restoration of the concession's economic-financial balance. The document highlights the continued negative cash generation and the company's high debt, including cases of default in the sector.
A ANEEL gave the company the opportunity to present a financial recovery plan or, alternatively, transfer share control, as provided for in Law No. 9.074 of 1995 and Normative Resolution No. 846 of 2019.
The controller chose the transfer of control and formalized the request on October 9, 2023, proposing Green Energy Soluções em Energia Ltda as the intended new controller.
Due to the non-approval of the request, the ANEEL, in accordance with the laws of the sector, will forward to the Ministry of Mines and Energy a recommendation to declare the expiration of the concession contract of Amazonas Energia SA
Until a decision is made by the Granting Authority, the obligation to provide the service remains with the current concessionaire, which remains under the regulation and supervision of the ANEEL.

It was not too late for the ANEEL made this decision and for everything our state suffers due to this company whose slogan is “More than energy, distributing solidarity to Amazonas”, but in fact does neither.
