After almost four years of slow progress in Congress, the Paten (Energy Transition Acceleration Program) is starting to take shape. The Senate Infrastructure Committee approved this Tuesday (3) the report of the rapporteur, Senator Laércio Oliveira (PP/SE), which institutes the initiative.

The PATEN establishes guidelines and principles for the production of renewable energy. In his report, Senator Laércio Oliveira defined the program as “one of the pillars of the green and low-carbon economy.”
Proposals for infrastructure works, expansion or implementation of sustainable energy production parks and technological research and development that generate socio-environmental benefits or mitigate impacts on the environment are eligible for the program.
Companies that Patem will be able to receive resources from the FNMC (National Fund on Climate Change) and negotiate debts with the Union through a transaction conditional on investment in sustainable development. Financing through the FNMC was one of the changes promoted by the Senate.
If it becomes law, the Sustainable Development Guarantee Fund (Fundo Verde), istered by BNDES (National Bank for Economic and Social Development), will come into existence. This fund would guarantee the risk of financing granted by financial institutions to holders of projects approved exclusively in the PATEN.
The law also guarantees that resources from energy distributors, previously reserved for energy efficiency projects, can be applied to the installation of photovoltaic s in facilities of non-profit community associations. The energy generated and not used by the entities can be directed to beneficiaries of the Social Electricity Tariff.
By law, distributors must reserve at least 1% of their operating revenue for research and development and energy efficiency programs. This source of funds is now available for distributed microgeneration projects.
“The program was designed to facilitate various projects that drive the energy transition and the reduction of carbon emissions. In short, Paten acts as a backbone of the sustainable economy, promoting economic growth based on principles of low environmental impact and contributing significantly to the construction of a more sustainable future,” he highlighted.
Originating from Bill 327/2021, by former deputy for Rio de Janeiro, Christino Aureo, it was initially called Ponte (National Energy Transition Policy).
The collegiate of senators promoted the change of nomenclature and expanded the scope of the project, adapting the text to other legislation recently approved by the National Congress, such as Hydrogen Legal Framework (Law 14.948), the Low Carbon Hydrogen Development Program (Law 14.990) and the Fuel of the Future (Law 14.993).
