Goiás grants tax benefit for biogas and biomethane production

The Government of Goiás approved Law No. 23.168/2024, which grants tax benefits to companies producing biogas and biomethane. Producers will be able to receive ICMS credits of up to 85% on domestic operations and 90% on interstate operations, reducing the taxes currently paid. The decree that will regulate the law is being analyzed by the Ministry of Economy and is expected to be published in February of this year. 

According to the government, the benefit is conditional on minimum investments in infrastructure and innovation, ensuring that companies contribute to the state's economic development. The tax benefit could reduce the ICMS rate from 19% to 1,2% for interstate operations and 1,8% for domestic operations. 

Biogas and biomethane are renewable fuels produced from organic waste, such as agricultural and animal remains. In addition to reducing greenhouse gas emissions, the technology attracts investment in energy infrastructure and strengthens the local economy.

Goiás has legislation that favors the production of renewable energy. Decree No. 10.256/2023 exempts ICMS on the acquisition of equipment for the assembly of photovoltaic systems in state public buildings. 

Decree No. 10.579/2024 defers ICMS on the import of machines, equipment and materials without a national equivalent intended for the capture, generation and transmission of solar, wind or biogas energy.

“With these initiatives, Goiás consolidates its role as a hub of innovation and sustainability, attracting strategic investments, generating jobs and fostering the development of a cleaner and more resilient economy,” declared Governor Ronaldo Caiado, in a press release.
