MME publishes guidelines for existing energy auctions

The Ministry of Mines and Energy (MME) published this Wednesday (30) the Normative Ordinance No. 107/2025, establishing the guidelines for carrying out existing energy auctions A-1, A-2 and A-3. 

The competitions are scheduled to take place sequentially on November 14, 2025, with a focus on guaranteeing the energy supply for the coming years in the Regulated Contracting Environment (ACR).

According to the ordinance, it will be up to the ANEEL (National Electric Energy Agency) to prepare the notice and the CCEARs (Energy Commercialization Contracts in the Regulated Environment). The energy negotiated will be contracted in the quantity modality, which means that the hydrological risks will be fully assumed by the sellers.

Supply deadlines

The contracts will have the following supply periods:

  • Auction A-1: starting on January 1, 2026 and ending on December 31, 2027

  • Auction A-2: starting on January 1, 2027 and ending on December 31, 2028

  • Auction A-4: starting on January 1, 2028 and ending on December 31, 2029

During the validity of the CCEARs signed in these competitions, electricity prices may not undergo any updates.

Statements of need

Distributors must submit their Declarations of Need for the years 2026, 2027 and 2028 between August 12 and 22, 2025. Subsequently, between October 21 and 31, agents may ratify or rectify these declarations, provided that there is previously ed demand.

Auction structure

The auction system will be divided into two stages:

  • Initial Step: period in which selling bidders may submit a single bid for the product under negotiation.

  • Continuous Stage: subsequent phase, in which sellers who submitted valid bids in the previous stage may continue submitting proposals for the same product.

Existing energy auctions are central instruments for maintaining the balance between supply and demand in the electricity sector, allowing the contracting of energy from projects already in operation and at more competitive prices.

With the publication of the guidelines, the expectation is that ANEEL start the public consultation soon to discuss the draft notices and contracts.
