Mato Grosso definitively vetoes ICMS charges on solar energy

In a unanimous vote, state deputies understood that charging the source tax is inappropriate

The deputies of AL-MT (Legislative Assembly of Mato Grosso) approved, last Wednesday (11), the 897 / 2021 Bill, which definitively vetoes the collection of ICMS (Tax on Circulation of Goods and Services) on solar energy generation systems in the State.

The text – authored by state deputy Faissal Calil (Citizenship) – will now go to governor Mauro Mendes (União Brasil) for sanction.

In the vote, the deputies unanimously understood that there is no triggering event in the “loan” of energy made by the who owns a solar energy plant, since the consumer only uses a resource that he himself produced.

According to Faissal, it is “impossible to charge any tax, as there is no circulation of goods and you are consuming your own product. This is, in fact, the Court's understanding of the matter (Learn more)”, he highlighted.
