The TCU (Federal Audit Court) resumes next Wednesday (7/8) the discussion about the term of office of the president of the ANATEL(National Telecommunications Agency), Carlos Baigorri.
A decision may impact the mandates of other directors of regulatory agencies, including that of the Director General of ANEEL (National Electric Energy Agency), Sandoval Feitosa.
The process analyzes whether Baigorri can serve an additional five-year term after a two-year period as a member of the ANATEL Board.
According to Regulatory Agencies Law (Law 13.848/2019), the term of office of directors and advisors of entities is limited to five years, without the right to reappointment. Baigorri was elected advisor to ANATEL in 2020 and, in 2022, assumed the presidency of the agency.
The TCU minister rapporteur of the process, Walton Alencar Rodrigues, proposed ending Baigorri's term in 2025, and not in 2027, as expected. The technical area of TCU, in turn, defends the end of the mandate in 2024.
A Court's decision may also affect the term of office of the Director General of ANEEL, Sandoval Feitosa, who was director of the entity between May 2018 and May 2022.
In August 2023, Feitosa assumed the presidency of ANEEL for a period of five years. However, there is an understanding that Feitosa would be treated differently, since he left the agency before taking over as CEO.
The process has been ongoing at TCU since 2022 and has not yet been voted on due to requests for review.
