Unanimously, the board of directors of ANEEL (National Electric Energy Agency) denied a request to review the compensation of power generators. The leadership followed the understanding of the Attorney General's Office, that the alleged losses on the part of the companies would be within the costs of the business.

The manifestation of ABSOLAR (Brazilian Association of Photovoltaic Solar Energy) was based on a change in rules from the Normative Resolution 1.073/2023, which changed criteria and procedures for determining and paying operating restrictions due to constrained-off.

The term is used by the sector for cases where there is an interruption in power generation due to operational restrictions and to avoid overloading the network – even if there is still management capacity. It differs from curtailment, which is related to scheduled shutdowns of transmission lines, and also due to excess supply in relation to demand.

Curtailment: is distributed generation to blame?

The association is in conflict with the ONS (National Electric System Operator), demanding greater transparency in the justification for the cuts, which claim losses of around R$2 billion. The group has already taken legal action against the regulatory agency demanding compensation.

Compensation to generators through ESS (System Service Charge) is only permitted in cases of lack of infrastructure for energy transmission. However, it is common for there to be excess supply in relation to demand, when the energy cannot be transported and there is no financial replacement.

A ANEEL denied the request for reconsideration by the ABSOLAR unanimously. However, two of its directors, rapporteur Fernando Mosna and Ricardo Tili, were in favor of opening a public consultation requested by the association, which questioned the transparency of the ONS. However, directors Sandoval Feitosa, Agnes da Costa and Ludimila Silva did not approve this last request.

The understanding of the prosecutor's office weighed in on the decision. ANEEL, that cuts in energy generation are associated with business risks.

Because the consumer always pays these bills? And when the loss is on the side of the Solar sector, we see a totally opposite behavior on the part of this agency... They tried to explain the inexplicable, pure lobbying in favor of the concessionaires that do not invest in network improvements...
