ANEEL shocks the DG sector in a meeting about the update of REN 482

The meeting was held this Friday during a meeting with entities from the electricity sector

During a virtual meeting with electricity sector associations this Friday (19), the ANEEL (National Electric Energy Agency) presented its vision on how the new proposal for reviewing REN 482 (Normative Resolution No. 482/2012) could take place. 

The meeting was held during “Coffee with GD”, a meeting promoted by ANEEL on Fridays with associations from the electricity sector linked to the subject. The agency's spokespeople were directors Efrain Cruz, Sandoval Feitosa and Hélvio Guerra.

Among the associations were ABGD (Brazilian Association of Distributed Generation), ABSOLAR (Brazilian Association of Photovoltaic Solar Energy), INEL (National Institute of Clean Energy) and Abrapch (Brazilian Association of PCHs and CGHs).

In an exclusive interview to Canal Solar, the president of ABGD Carlos Evangelista, reported how the meeting went. The executive clarified that right at the beginning of the presentation, ANEEL showed his vision on what should be done via bills and what should be done via agency regulations.

According to ANEEL, the SCEE (Electric Energy Compensation System), the most controversial topic of the review of resolution 482, should be discussed via a bill. In an interview with Epbr last Wednesday (10), André Pepitone, general director of ANEEL, had already mentioned this position of the agency, as conveyed by report from Canal Solar  

“A ANEEL made it clear that part of new installations, existing installations, differentiation by sources and new forms of association, should be governed by a bill”, reported Evangelista. 

After informing that it should discuss topics related to sector regulation, such as B optant, availability cost, access rules and distributor delays, the agency presented to the associations its vision of how the compensation system should be carried out, highlighting that this topic should be the responsibility of the National Congress, citing PLS 232/2016, which is being processed in the Legislature. 

During the presentation of its vision of how the compensation system can be designed, the ANEEL proposes that the maintenance of rules for installed systems be up to 12 years.  “The agency said that those who have the system installed continue the rule as it has been for 12 years. This is terrible for anyone who has invested in solar energy. The current rules must remain in place for at least 25 years.”

“Firstly, to be consistent with the acquired right, and secondly because it is the duration of a system. There are several business models that were installed considering that the systems would be operating following the current rules for 25 years. By changing this scenario, several businesses are destroyed”, added Evangelista.

This position of the ANEEL contrasts with the statement made by Bento Albuquerque, Minister of Mines and Energy, in 2019 on the subject. “The contracts that exist will be honored. The ANEEL, in a resolution, already mentioned that this incentive would be for 25 years and this will be respected. We will work together with Congress, as we already are, so that there is a transition in this period, which goes until 2040, so that all consumers benefit”, according to a report by State Agency.

Furthermore, the agency mentioned that an assessment of the sources will be made, but did not explain how this process will take place. ANEEL also indicated during the meeting that, in addition to consortium and cooperative, there will also be voluntary civil condominium among the business models.

According to the president of ABGD, the vision of the energy compensation system presented by the agency is similar to the proposal for option 5, put forward at the end of 2019. “The content is exactly the same. It's scenario 5 of 2019, only now with a transition. In the first and second year, 60%. In the third and fourth year, 50%. In the fifth and sixth year, 30%, and in the seventh and eighth year, 10%.”, says Evangelista.

For Hewerton Martins, president of MSL (Free Solar Movement), there is nothing new in the presentation of ANEEL. “The Movimento Solar Livre association did not identify anything new in Aneel’s proposal in relation to what was presented in October 2019, when it presented consumers with the so-called alternative 5, proposing to tax those who produce their own energy at home by more than 60%,” he highlighted.

"ANEEL via its director in an article published in Canal Solar on February 15, that is, 5 days ago, said it was in favor of Distributed Solar Generation, what they verbally presented today is the same proposal as in 2019 with taxation above 60%”, he added.

“The MSL is mobilizing FAIRES (Front of Regional Solar Energy Associations and Institutes) from each state, together with APROSOJA (Brazilian Association of Soy Producers) and the association of Sebrae Nacional for a large mobilization to raise awareness among parliamentarians in Brasília in the next few days”, concluded Martins.

“After the first positioning of the ANEEL, in 2019, the sector made itself available and has been maintaining for some time, through a suggestion from INEL itself, a sequence of meetings and interactions with the agency itself to clarify the gains and advantages to society brought by the distributed generation of solar energy”, highlighted Heber Galarce, president of INEL.

“Now, for the second time, it cannot be a mistake on the part of the agency, but rather an insistence that takes away benefits from all Brazilians. Who is interested in this positioning of the agency? ANEEL contrary to democratized solar energy and, clearly, divergent from the Federal Government?”, added the executive.

In a statement to the solar sector, the ABSOLAR (Brazilian Association of Photovoltaic Solar Energy) stated that “the proposal does not favor the development of GDFV (distributed solar photovoltaic generation) in Brazil”.

Through a video posted on social media, Bárbara Rubim, vice president of Distributed Generation at ABSOLAR He said that “although it is still a draft, that is, it is not the agency’s final proposal and it does not mean that it will be the proposal that will be debated and discussed in the National Congress. It is very important that we, as sectors, are united and prepared to present our contributions to this material.”

In order to discuss the topic and send suggestions to ANEEL, ABSOLAR will hold an online meeting next Tuesday (23), at 16:30 pm. The event will be open. Next Wednesday (24th), the ANEEL should meet with the associations to receive contributions on his presentation this Friday.

    Hydroelectric plants lose around 50% of the energy generated in transporting this energy on the grid to the destination, and the final consumer pays for this loss.
    As the corrupt people didn't get permission to build more hydroelectric plants, they are trying to collapse energy in Brazil by making DG unviable, and then tell the government, the media and the people: “Look... There's a lack of energy, DG isn't helping, we need to do more hydroelectric plants”.

    It's a 3rd world thing where corrupt people are not punished, and a minority gets rich and concentrates wealth in the hands of a few.

    The discussion reaching the STJ, STF, is doubtful whether they will act according to the laws, CF, norms, laws, as they already have a history of deciding things overriding everything, there are more corrupt people in the STJ and STF.

    Or keep postponing the definition, and turning a blind eye to companies that charge fees, taxes that they shouldn't charge.
