The board ANEEL (National Electric Energy Agency) met, this Thursday (13), with associations from the electricity sector to discuss the regulation of Law 14.300/2022.
According to the entities participating in the meeting, the objective was to discuss how the law could be implemented in a sustainable manner. To this end, the Agency reported that a public consultation will be opened to hear from civil society and other stakeholders in the electricity sector.
During the meeting, the associations expressed their concerns regarding the use of excerpts Technical Note 041/2022 by distributors to prevent access to DG (distributed generation) facilities. The ANEEL took a stand warning that this would be an abusive practice by dealerships.
“Many items of the Law are not being complied with by the concessionaires, as items of the technical note ANEEL are being treated as if they were Law”, said Tássio Barboza, Deputy Secretary of Distributed Generation at INEL (National Institute of Clean Energy).
Barboza also informed that INEL expressed its concern regarding the difficulties that consumers have faced in qualifying for the B-Optante tariff modality. Furthermore, the question was raised about the maximum battery capacity limit suggested in Technical Note 41/2022 when it comes to hybrid systems.
Also during the meeting, PL 1709/2022 was mentioned, which is being processed in the Chamber of Deputies and aims to change some sections of Law 14.300.
According to Barboza, the rapporteur of NT 41/2022, director Hélvio Neves Guerra, stated that he is extremely in favor of renewables and also of DG. The INEL secretary also informed that the association has already created a technical group to work on the topic and is only waiting for the formalization of the public consultation, to send the suggestions.
“In parallel, INEL is organizing dinners with presidential candidates to discuss clean generation public policy”, added Barboza.
In addition to INEL, the following organizations participated in the meeting: ABGD (Brazilian Association of Distributed Generation), ABRADEE (Brazilian Association of Electric Energy Distributors), ABSOLAR (Brazilian Association of Photovoltaic Solar Energy), MSL (Free Solar Movement) and others.
O Canal Solar ed the ANEEL, who confirmed that the reporting director of the process Hélvio Guerra met with the associations about the technical note from the Agency's Regulation area to the regulation of the topic in ANEEL.
