A ANEEL (National Electric Energy Agency) reported that will publish, in an extra edition of the DOU (Official Gazette of the Union) this Monday (7), a dispatch on approval, sub judice, of the transfer of corporate control of the distributor Amazonas Energy for the company Amber Energy.
According to the Agency, the publication will take place in strict compliance with a court decision of the Federal Court of Amazonas, which had forced the local authority to approve the deal according to the conditions presented by Âmbar at the end of June.
O plan approved by ANEEL, in compliance with the court decision, will have a cost of R$ 14 billion over the next 15 years, with flexibilities that will be covered by the CCC (Fuel Consumption ) and a capital contribution of R$6,5 billion to reduce Amazonas Energia's debt.
“The approval of the Corporate Control Transfer Plan is naturally precarious and will only last as long as the court decision is in force, in view of which the ANEEL will continue to make efforts in procedural action, whether in the Instrument Appeal already filed, or in new measures to be evaluated with the contentious action bodies of the Federal Attorney General's Office", highlighted, in a note, the ANEEL.
Understand the Amazonas Energia imbroglio
Amazonas Energia, the company responsible for distributing electricity services in the state of Amazonas, is facing a financial crisis that has led to the ANEEL recommending the termination of the company's contract in November 2023.
The Agency justified that the concessionaire did not have the financial conditions to maintain the concession, which could put the supply of electricity to the Amazonian population at risk.
As a result, a provisional measure was published by the Federal Government and determined a change in control of the distributor.
According to the text, the acquirers would have to present a plan for the transfer of corporate control, which would have to be analyzed and approved by the ANEEL.
In June, Âmbar Energia presented a plan to take control of the distributor, which was considered unsatisfactory by the company's technical area. ANEEL for not resolving the company's debt.
After a series of legal measures, the Agency's board of directors approved last week the transfer of corporate control of Amazonas Energia to Âmbar Energia.
