The board of ANEEL (National Electric Energy Agency) unanimously approved, this Tuesday (18), the opening of a public consultation for the Free Energy Market. In the next 47 days, subsidies and additional information will be collected to improve the regulatory process of distribution services for Group A consumers – those connected in medium and high voltage.

The rapporteur for the process, director Ricardo Tili, has been following the issue for a few years. However, he did not expect to be chosen as rapporteur, as his term at the agency ends in May, a period in which the debate will not be concluded. However, he considered the importance and need for public consultation for the development of the Free Energy Market (Open Energy), which led to his vote being followed by the other four directors. The approval was celebrated by the Vice President of Strategy and Communication of hug (Brazilian Association of Energy Traders), Bernardo Sicsú.

“This is an important process for the development of the free market, which last year broke a historic record, with growth of 67%. We have seen a growth in consumer units of decades in months in the free market, which is where the context of this discussion arises, which is essential for us to this growth of the free market, which is close to retail, given this consumer desire for cheaper, renewable energy and better services”, he highlighted.

Among the points that will be discussed based on the public consultation, Sicsú highlighted the possibility of reducing the 180-day deadline for migrations to the free market. One of the ideas suggested would be a new deadline of 90 days. “One of the advances from public consultation 28, which ended in 2023, was to allow an indefinite deadline for energy contracts, so that all migrations to the free market occur within 180 days, and now we are very positive about the ANEEL bringing to the discussion the possibility of reducing this period, which is one of the central points”, he added.

Migrations triple in 2024 and break record in the free market

The public consultation, therefore, should last until April 7, when the process is likely to return to the top management. ANEEL to present the information gathered and establish the next steps. In addition to fostering competitiveness, the procedure aims to prepare for the inclusion of Group B, residential consumers, in the free energy market. Open Energy already exists in European countries, such as Italy and Spain, as well as in the United Kingdom. It is also present in the United States and Canada.

This involves the establishment of a digital platform that allows data sharing, streamlining the process and focusing mainly on the energy consumer, in addition to establishing new business models and allowing greater transparency. If there is no judgment by May, when the rapporteur's term at the regulatory agency ends, a new director will be drawn to continue voting.
