Unanimously, the board of directors of ANEEL (National Electric Energy Agency) denied the suspension of fines for solar and wind generation companies by the blackout occurred on August 15, 2023, when several states in Brazil suffered a blackout.
Abeeólica (Brazilian Association of Wind Energy and New Technologies) and ABSOLAR (Brazilian Association of Photovoltaic Solar Energy) had filed a request for a precautionary measure to suspend the punishments until the conclusion of a technical analysis, which was overturned by the top management of the Regulatory Agency.
The entities requested a review of the RAP (Disturbance Analysis Report) made by the ONS (National Electric System Operator) on the causes of the occurrence.
By January 2025, 750 fines had been issued to agents in the wind and photovoltaic sectors. The fines in question have already exceeded R$150 million.
Since then, the associations claim that renewable projects have been subject to recurring cuts determined by the ONS, in significant volumes, “without any control or responsibility” over these events.
The losses from cuts to wind and solar power plants, in addition to the liabilities from accumulated waste of clean energy, total more than R$1,7 billion in the last 15 months.
