Unanimously, the ANEEL (National Electric Energy Agency) confirmed expectations and declared the instruction process of LRCAP 2025 (Capacity Reserve Auction) in the form of Power to be terminated. The auction was scheduled for June 27, and would be intended for the contracting of electrical power from generation projects that added electrical power to the SIN (National Interconnected System).
The rapporteur of the process, Ricardo Lavorato Tili, considered that the public consultation to gather subsidies regarding the LRCAP notice was compromised due to a normative ordinance from the Ministry of Mines and Energy, which revoked the auction bases.
“I understand that, if the Granting Authority establishes new guidelines for this auction, all the learning and documents written in this process may be used as a basis, to the extent that is appropriate and pertinent, in any new instruction”, said Tili, in his vote, accompanied by the other directors, Agnes Aragão, Fernando Mosna, Ludimila Silva and Sandoval Feitosa – the latter, the agency’s general director.
In April, the Federal Court of the Federal District had already suspended the LRCAP 2025, on a preliminary basis. A lawsuit filed by the consumer protection association Proteste questioned the legality and impacts of the initiative for consumers.
The entity claimed that the auction was not properly discussed with society and could bring additional costs without adequate technical justification. Subsequently, the Minister of Mines and Energy, Alexandre Silveira, criticized the judicialization of the auction and went as far as to say that “in the regulatory area, interests are very controversial”.
He also stated that holding the contest did not depend solely on the government's will. He even ordered a new public consultation. “The legal proceedings prevented us from moving forward,” he declared, back in April.
