Associations question ANEEL about the Resolution that regulates Law 14.300

Appeal filed with the Agency inquires about several points raised by Resolution 1059

ABGD (Brazilian Association of Distributed Generation) and ABS (Bahia Solar Energy Association) filed an istrative appeal with the ANEEL (National Electric Energy Agency), questioning inconsistencies in the Normative Resolution No. 1.059/2023, which amended Normative Resolution No. 1.000/2021 in relation to Law 14.300/2022.

In a statement, the associations reported that the main themes were:

  • (i) – Art. 655-O – The necessary suspension of the injection period due to pending work (work) at the concessionaire;
  • (ii) – Art. 71 – The necessary granting of time in the case of remediable defects;
  • (iii) – Arts. 292 and 671-A – Undue restrictions on the B-Optante consumer;
  • (iv) – Art. 655-G – Preventing the transfer of credits to the same holder
  • (v) – Art. 655-I – Charging Availability Costs and obtaining guarantees;
  • (vi) – Art. 655-I – Charging the Tariff for Use of the Distribution System for Generators (TUSD g) charged, in consumption, on a monomial basis (low voltage units and B-Optants);
  • (vii) – Art. 655-E – Subdivision of plants subjectively.

“Soon, we will bring news about the appeal presented, which will serve as a legal basis for ABGD and ABS ”, concludes the associations’ statement.

  1. The crying from the GD people is already too much. And it's actually not that distributed, since the main complaints are the large remote generation projects, which are practically centralized generation that want distributors to transport their energy for free. And make no mistake, this is not about the solar on the consumer's roof, these are large economic groups making large profits from not paying for services provided by others.

In fact, the distributors already earn too much and the networks are out of date, they don't invest anything, the number of household appliances and electrical equipment in homes has increased and is increasing and the distributors have not adapted, not to mention that there are companies that are not even working because the distributors do not have the capacity to deliver electricity to them. Furthermore, they serve you poorly and always exceed the deadline they stipulate for the services you request. Distributors are a shame, if they don't have the conditions and capacity to serve customers, they sell to those who do.
