The CGU (Controllership-General of the Union) will carry out a complete audit of the inspection processes of ANEEL (National Electric Energy Agency), at the request of President Luiz Inácio Lula da Silva.
The body seeks to understand what measures were adopted in relation to Enel SP, a dealership that serves the state of São Paulo, since blackout occurred on November 3, 2023, when more than 2 million consumer units were without power for almost a week.
The topic gained prominence afterplague of October 11th, which left 2,1 million homes in São Paulo without power again. Five days after the incident, around 100 properties still remain in the dark. The Government is pushing for power to be fully restored in the capital of São Paulo, in addition to demanding an investigation and possible punishments in the event of failures.
According to the Comptroller General of the Union, Vinícius Carvalho, the penalty for poor public service provision may be the termination of the concession, decision that will only be taken after an istrative process, with full defense of those involved.
“A series of istrative measures will be necessary in this process, on the part of the ANEEL and, perhaps, the Regulatory Agency of the State of São Paulo (ARSESP). We, at the CGU, will monitor the development of these measures, participate in the discussions, evaluate them as to their necessity and suitability to the situation and, if necessary, hold those involved in the public istration able,” Carvalho said at a press conference last Monday.

Present at the same press conference, the National Consumer Secretary of the Ministry of Justice and Public Security (Senacon/MJSP), Wadih Damous, stated that The City of São Paulo can also be held responsible due to the lack of planning in pruning trees and the delay in removing those that fell on the power grid.
Collective action
The minister of the AGU (Attorney General's Office), Jorge Messias, does not rule out a collective action for moral damages. “As the Attorney General's Office, we are evaluating, in view of Enel's repeated practices, the promotion of a collective moral damages action due to the contractual violations committed by this electric power concessionaire. Aneel applied the largest fine in the history of the electric sector, more than R$200 million, and the company managed to suspend this fine in court.”
Repairs
People who have had their goods and appliances damaged should ENEL SP's communication channels to request repairs. “We want all those affected, whether commercial establishments or individuals, to seek compensation. We will also ask the company to widely publicize the channels through which those affected can report their losses,” said Minister Paulo Pimenta (Secom).
