Enel-SP, an electricity concessionaire that operates in the capital of São Paulo and Greater São Paulo, was fined by Procon-SP in R$ 13,3 million due to the “poor provision of services” during the blackout in October. At the time, more than 3 million customers were left without access to electricity due to a severe storm.
This is the third time the company has been penalized by Procon-SP in 12 months due to inadequate service provision. In the first two cases, the fine was R$12,7 million.
The first fine was motivated by the company's lack of action in blackout in November last year, when more than 2 million people were left without electricity for days.
The second penalty was related to blackout recorded in March this year. The problem interrupted the energy distribution service for merchants and residents in the central region of São Paulo and the company took days to restore the service.
Regarding the October rains, which led to the fine by Procon-SP, Enel-SP claimed that the storm was the strongest recorded in the Metropolitan Region in the last 30 years and that a third of the 3 million affected customers had their power restored that same night.
At the time, the company also said that it had to rebuild entire sections of the power grid and gradually restored power to all affected customers in less than six days.
Fined by ANEEL
In addition to Procon-SP, the distributor has also been fined this year by ANEEL (National Electric Energy Agency), which applied a fine of R$165,8 million for failures in the provision of services in the blackout that hit the city in November last year.
The regulatory body understood that the distributor breached the concession contract for the São Paulo electricity grid by not guaranteeing energy to residents affected by the storm that hit the city. In addition, it was found that there was a delay in allocating teams to respond to the incident.
Net profit
Two days after being fined by Procon, the Enel Group announced that it recorded an ordinary net profit of €5,8 billion in the first nine months of 2024 – a growth of 16% year-on-year.
The company's revenue totaled €57,6 billion from January to September, down from €69,5 billion in the same period in 2023. In Brazil, revenue was €5,665 billion – down from €5,8 billion the previous year.
