A Justice of Cuiabá-MT determined that the credit unions da Central North Center, from Sicredi, are again classified in the category B Opting – group of consumers who, although served at medium or high voltage (i.e., Group A) can choose to be billed in the same way as those in Group B.

Basically, consumers of Group A, such as industries and large commercial establishments, have the option of being part of this billing class, which does not require estimated payment by the contracted demand, only energy consumption and other charges. 

However, with the publication of the regulation of Law 14.300 from ANEEL (National Electric Energy Agency), the rules have changed so that industries and commercial establishments that were part of group B Optante returned to the Group A billing. 

In the files, the cooperatives of Sicredi claimed that they carried out a investment of BRL 30 million in a 7 MWp photovoltaic plant, in Nova Xavantina (MT), when they were still part of the Optante B category and the project took risks, since the amount saved with own solar energy generation could be used to pay for the contracted demand. 

In your decision, judge Ana Paula da Veiga Carlota Miranda assessed that it wouldn't be fair to subject Sicredi to the new rules, since a cooperative presented the requirements to be part of the group B Opting very before the regulation of ANEEL.

“It is clear that the plaintiffs, credit cooperatives located in several cities in the states of Mato Grosso, will suffer losses with the change and taxation proposed by the defendant, as they made a large investment in a solar plant, which is one of the reasons for generating solar energy. remotely and the option for Group B billing”, highlights the magistrate’s decision.

    Excellent news and that this attitude is adhered to by magistrates throughout the national territory, since energy concessionaires only think about them, small energy producers may suffer sanctions, which in this case could make the implementation of solar plants, in other words, clean energy. , unfeasible, once you see they are close to us.
    I hope that micro and mining energy producers come together more to seek and demand public policies from governments to encourage the spraying of mines and micro renewable energy plants.
    Brazil needs this energy, the world needs this energy (IDEIA).

    If possible, I would like some clarification. How did Sicredi manage to qualify as a group B opter for this plant? If it has a size of 7 MWP.

  3. What a strange case. In my opinion, it would be more advantageous for the cooperative to enter the free energy market, especially with low prices. And the plant, which has already been built, could be sold to some large consumer or sold at retail to its . The A4 green TE+TUSD tariff is R$462,3 without taxes. I don't see how it wouldn't have a better result in the free market, since the tariff would go to R$300. I didn't consider peak hours, since energy consumption during peak hours is small in this type of operation. Is this a fight worth fighting? Could Sicreed have been induced?
