The board of ANEEL (National Electric Energy Agency) began to unblock an agenda that had been accumulated for eight months. This was the period in which the leadership had one less member, since the departure of Hélvio Guerra, in April.

With several complaints about the backlog of cases and successive ties, the arrival of the substitute director Ludimila Lima da Silva was crucial for the other to “breathe their feet”. Received with applause and a full room, she broke the tie in nine votes that were dormant on the agency's agenda with a 'score of 2 to 2'.

Presented at the meeting this Tuesday (28), the second of the year, the director broke a tie in a series of processes that were tied. During the three and a half hour session, almost two hours were used to resume the accumulated votes.

Proposals to open a public consultation, istrative appeals by companies, requests for reconsideration filed by companies, everything was being accumulated by two votes for or against.

In a public hearing at the end of last year in Câmara dos Deputados, general director Sandoval Feitosa cited 19 tied processes, which had been damaging the regulatory agency's image.

“The seat next to me in the plenary was empty for eight months. I am very pleased with the arrival of Director Ludimila, not only because she is a qualified person, but also because of the drawing of cases, because now the chance of me receiving a case decreases a little, and I am able to reduce my caseload”, joked Director Fernando Mosna, who is sitting next to the new director at the table. ANEEL.

The relief, however, may have a limited term. And for two reasons. As a substitute director, Ludimila will only be able to spend up to 180 days in the role, which would require the appointment of another name if a regular director is not appointed.

Furthermore, director Ricardo Tili's term ends on May 24 of this year. Judging by the delay of the Federal Government, which was unable to indicate a name to succeed Hélvio Guerra, the horizon for the agency is cloudy.

It is worth ing that there was a crisis between the Minister of Mines and Energy, Alexandre Silveira, and the President of the Federal Senate, Rodrigo Pacheco, who rejected two names that President Lula's aide tried to place in the regulatory agency.

The ime has been widely criticized by Sandoval throughout 2024, and the apparent solution is unlikely to hold fire for long. Silveira has already made political accusations against the board of directors. ANEEL, of “not working for the Country” due to ties – which in turn were attributed to the failure to appoint a director by the current Federal Government.

What was discussed

Among the decisions taken, the partial approval of the proposal to open a Public Consultation to debate the tariff impacts of the early settlement of the Covid and Water Shortage s stands out.

In addition, the Agency rejected istrative requests from Echoenergia Participações SA and Neoenergia related to participation in the energy allocation mechanism from the ACL (Free Contracting Environment) to the (ACRA Regulated Contracting Environment), as provided for in the Commercialization Rules.

Another rejected request was that of PCH Mantovilis SPE SA, which sought recognition of exclusion of liability for the delay in the implementation of the Mantovilis Small Hydroelectric Power Plant.

Within the scope of penalties applied to concessionaires, the ANEEL maintained the fine of R$3,4 million to CEEE-D (State Electric Energy Distribution Company), as a result of power outages recorded in the urban area of ​​Porto Alegre, in addition to denying an appeal by the same company against another penalty imposed by AGERGS (State Agency for the Regulation of Delegated Public Services of Rio Grande do Sul) for non-compliance with electricity sector regulations.

Among the other deliberations, the ANEEL partially granted the request for reconsideration of São Martinho SA regarding the electrical interconnection between the Boa Vista and São Martinho Boa Vista Thermoelectric Plants.

Atmo Comercializadora de Energia Ltda. obtained a favorable decision granting a suspensive effect to its request to challenge a disconnection procedure at CCEE (Electric Energy Trading Chamber).

On the other hand, the Agency denied the request of Kamai Solar Power Ltda. for the issuance of connection quotes by RGE Sul Distribuidora de Energia SA, in addition to rejecting the request for adjustment in the concession period of the Cazuza Ferreira Small Hydroelectric Plant, which had been based on Law No. 14.120/2021.
