ONS makes changes to transmission services ANEEL

The ONS (National Electric System Operator) changed the rules contained in Module 5 of the Transmission Services Rules ANEEL (National Electric Energy Agency), Normative Resolution No. 1.069/2023.

The changes came into effect on March 1st and refer to the new rules for granting, access and contracting for power generating plants.

The objective is to update the regulation of access to transmission in the scenario of expansion of wind and photovoltaic generators. In this way, it makes the process more agile, efficient and less bureaucratic.

Some of the main changes include new guidelines related to the inversion of phases to obtain the grant, changes in the rules for starting the execution of CUST (Transmission System Use Contracts), reductions in MUST (Transmission System Use Amounts), postponement of MUST, among others.

Since September 1, 2023, the ONS requires the presentation of the GPA (Guarantee of Access Opinion), making the request agent more committed to the access process. 

This amount can be returned, kept in force to obtain in the event of a runoff margin being released or added by the ONS.

The Normative Resolution also established the end of Access Information and the inversion of phases in the access process. Therefore, the generating agent does not need to be authorized to request access to the ONS. To request and obtain the grant, the following documents are required: Access Opinion, and CUST or CUSD.

The ONS will periodically publish the incremental Margin Map to access requests.

Understand the steps of the new transmission access process

With the changes in the rules for access to the transmission system ANEEL, the generating agent must present the GPA, which is the Financial Guarantee for the Access Request. 

GPA aims to increase the agent's commitment to the process, which is why the amount needs to be collected and is calculated as follows: 3X MUST/D (amount of requested usage) X TUST (usage fee).

The step-by-step process is as follows: presentation of the GPA; issuance of the access report; within five business days the agent can choose to return the GPA or maintain the fee; if the agent does not choose to return or maintain the GPA, the contract is signed, the GPA is activated or the refund is compulsory, according to the infographic below.
