PL aims to deregulate engineering: what impact on the solar sector?

O PL 3081 / 2022 directly impacts the solar energy market, particularly with regard to ART (Technical Responsibility Note). This is what electrical engineer Genilson Pavão, federal advisor for Maranhão at Confea (Federal Council of Engineering and Agronomy) said.

Authored by federal deputy Thiago Mitraud (Novo/MG), the project, which is awaiting dispatch from the president of the Chamber of Deputies, aims to deregulate professions that do not pose a risk to safety, health, public order, individual or property safety. Among the activities, for example, is the engineer (Decree Law 8620 / 46).

"How can an untrained person sign an ART? It’s a pointless project, which must have some political motivation behind it that we don’t know about”, added Paulo Edmundo Freire, professor at the Grounding Course do Canal Solar and managing partner of Paiol Engenharia.

For Sérgio Santos, electrical engineer at Lambda Consultoria, bill 3081/2022 in relation to engineers, and electrical engineers in particular, is extremely harmful to society, as it deregulates an activity related to energy supply, which involves economic aspects and security.

“Electricity is an extremely technical topic, which must be studied through a well-defined curriculum. By deregulating the profession, we will have people, not professionals, working in the market, without the slightest qualification to design, install or maintain electrical installations in companies or homes, exposing society to all types of risk”, he said.

“Unfortunately, this absurd initiative could bring a low-skilled workforce to the photovoltaic solar energy sector, which will greatly increase the number of accidents involving these people and their customers”, said Santos.

In his view, if solar has contributed to the development of Brazil, this is due to the engineers who work in the segment, who studied, graduated and continue to study to offer increasingly better products and services, “as long as they do not find themselves untimely having of competing with people who do not have the slightest professional training to work in this area”.

Repudiation note

CREA-SC (Regional Engineering and Agronomy Council of Santa Catarina), released a rejection note against the PL. Check out:

“CREA-SC is vehemently opposed to Bill 3081/2022, which deregulates professions and activities that “do not pose a risk to safety, health, public order, individual and property safety.

Among the activities are the professions of Engineer, Geographer, Geologist, Occupational Safety Engineer and several others of extreme importance to society.

Our professions are regulated by Law 5.194, of December 24, 1966, and we will not give space to this type of disrespect for technical responsibility in the technological area, which is at the forefront of essential services for development, quality of life and sustainability .

The Regional Council of Engineering and Agronomy of Santa Catarina is in favor of the complete archiving of Bill 3081/2022 and calls on professionals to vote in petition in favor of archiving.”
