It was published this Thursday (13), the MP (provisional measure) 1232/24, which makes it possible to transfer of shareholding control of Amazonas Energy, a distributor responsible for bringing electricity to the state's 62 municipalities and which is going through a financial and operational crisis. 

O text changes two laws in the electricity sector: Law 12.783/13, which deals with concessions, and Law 12.111/09, which deals with isolated systems.

By MP, the ANEEL (National Electric Energy Agency) may, as an alternative to terminating the concession due to the problems, approve a plan to transfer corporate control of the company, if you recognize the loss of the conditions to provide the service granted to the distributor.

O new controller will need to demonstrate technical capacity e Valuation to adapt the distribution service. Furthermore, will also need to present benefits to the consumers served.

The MP also determines that the transfer of control occurs for a symbolic value. 

It will be the responsibility of ANEEL analyze and deliberate on plans for the transfer of corporate control, and on the conditions for renegotiating the distributor's debt with the most representative creditors, in an istrative process that ensures the transparency of the process.

A MP also contains other measures, how to change the energy purchase and sale contracts that Amazonas Energia has with gas thermoelectric plants located in Manaus (AM). 

These contracts, which have not been paid by the distributor, may be converted into another contractual modality - CER (Reserve Energy) -, the value of which is shared among all Brazilian consumers, through an already existing charge on the electricity bill.
