O Senate approved, with amendments, the PL 528 / 2020 and a amendment information which aims extend the deadline for starting energy injection for projects from 12 to 30 months GD (distributed generation), regardless of the source used.
Valley amendment proposes a correction in the Law 14.300 / 2022, which previously imposed stricter deadlines for mini solar generators, making it difficult for the sector to develop new projects.
Senator Irajá (PSD-TO), author of the approved amendment, justifies the proposed change claiming that by extending the term, the aim is provide more adequate time for the execution of projects, investments and necessary hiring, without modifying the rights already provided for by law.
“Regardless of the source, projects, investments and hiring of service providers are necessary, which, in most cases, demands time and frequent adjustments. Therefore, it is more than fair that the reasonable and rational period of 30 (thirty) months for other types of mini-generation be extended to solar energy”, highlights the author of the text.
O PL 528 / 2020, in which this amendment was inserted, aims to create national green diesel, sustainable aviation fuel and biomethane programs. The project, popularly known as the Future Fuels Bill, also plans to increase the mix of ethanol in gasoline and biodiesel in diesel.
Technical evaluation
To Bernardo Marangon, director of Prime Energy and a professional with extensive experience in the DG sector, new amendment for the solar sector is positive, as it guarantees “more time for the entrepreneur to connect their distributed generation plants to the grid and qualify as GD I. Many professionals had already missed the injection deadline”, he commented.
In this new context, the executive said he believes that the country will see many GD I projects being connected in 2026 and early 2027, in addition to a larger volume being able to enter in 2025. “In this way, supply of GD I in minigeneration must be expanded”, stressed Marangon.
However, the professional also highlighted that it is It is essential that the sector monitors the progress of this amendment, while taking into the potential regulatory and tariff challenges that may eventually arise.
Next Steps
As several amendments were approved, one of which was the extension of the energy injection period for DG projects, the PL 528/2020 will be forwarded for a new vote in the Chamber of Deputies. If approved, it will be forwarded for presidential sanction.
As found out by Canal Solar, parliamentarians from parties allied with the Federal Government, such as PDT, PSB and PT, were against the approval of the amendment, which means that there is a probability that President Luiz Inácio Lula da Silva (PT) will sanction PL 528/2020 with vetoes, excluding the amendment in question.
