Law 14.620/2023, which provides for the Minha Casa, Minha Vida Program, was published on July 13th and brought as a major innovation the insertion of solar energy projects, through the execution of works to implement public equipment, including educational ones. and cultural, mobility, sanitation and infrastructure, including those for the installation of photovoltaic solar energy equipment, those for generating electrical energy from the generation modalities achieved by Law No. 14.300, or those that contribute to reducing consumption of water in real estate units.
The importance of the Minha Casa, Minha Vida Program came at a time of resumption of Brazil's Reindustrialization Process and its purpose today is not only to promote the right to the city and to housing for families living in urban and rural areas, but also the insertion of clean and renewable energy projects that will promote urban, economic, social and cultural development for citizens, sustainability, the reduction of vulnerabilities and the prevention of disaster risks, the generation of work and income and the elevation of housing standards , socio-environmental security and quality of life for the population, as determined by articles 3 and 6 of the Federal Constitution.
However, the possibility of using DG (distributed generation) projects, in modalities such as consortium, cooperative, voluntary civil condominium or building or any other form of civil association constituted by local leaders, also seeks to encourage the local workforce in a to insert a new chain of social and local economic development so that the population of that location can benefit from income and employment, social guidelines determined by law.
The big news with the insertion of Distributed Generation projects is the concept that DG energy is carried out on a smaller scale (microgeneration or minigeneration), close to the consumption center, and has been an opportunity for consumers who intend to reduce the amounts they pay for electricity tariffs, as they themselves act as energy producers, as regulated by Federal Law No. 14.300/2022 and in Resolution ANEEL No. 1.059/2023.
The law also brings the establishment of rules by ANEEL for the real estate developer to invest in electricity distribution networks, identifying situations in which the investments represent anticipation of mandatory service from the concessionaire, in which case they will be entitled to reimbursement from the concessionaire, based on regulatory evaluation criteria, and those in which the investments are configured as being of restricted interest to the real estate developer, in which case they will not be entitled to reimbursement (Art. 13§ 2º of Law 14.620/2023) and follow some guidelines as determined by the Law:
- The investment and cost of the operation to carry out infrastructure works linked to housing projects may be subsidized or financed by the Program resources provided for in art. 6 of this Law;
- The Minha Casa, Minha Vida Program will subsidize the training of local leaders for the operation and maintenance of photovoltaic systems, local or remote, or other renewable sources.
Another important point of the program complies with the specific regulations for each source of resources and the necessary linkage, which must be respected to meet the program's service lines, which are likely to comprise the investment value and the cost of the operation, among others, let's see:
- Preparation of studies, plans and social technical projects for infrastructure, public equipment, mobility, sanitation, urban planning and housing;
- Acquisition of properties;
- Urban land regularization, under the of Law No. 13.465, of July 11, 2017;
- Acquisition or production of housing units or projects;
- Improvement, expansion and recovery of housing units, including those intended for environmental and climate adaptation;
- Redevelopment of properties;
- Execution of works to implement public equipment, including educational and cultural, mobility, sanitation and infrastructure, including installation of photovoltaic solar energy equipment, generation of electrical energy based on the generation modalities achieved by Law no. 14.300, of January 6, 2022, or those that contribute to reducing water consumption in real estate units.
Thus, some of the main objectives of the Minha Casa, Minha Vida Program are:
- Reduction of social and regional inequalities in the country;
- Expanding the supply of housing to meet the housing needs, especially of the low-income population and in regions with greater housing deficits, in its various forms of service;
- Promotion of the improvement of existing housing, including the promotion of accessibility, to repair housing inadequacies; strengthening access to infrastructure and urban public facilities, including educational and cultural ones, in the vicinity of new housing units;
- Stimulating the modernization of the housing sector and technological innovation with a view to reducing costs and production and delivery times, environmental, climate and energy sustainability and improving the quality of housing production, with the aim of expanding housing services;
- Generation of employment and income in an economy structured on a sustainable basis;
- Stimulating and facilitating the implementation of connectivity infrastructure and telecommunications and internet services to reduce digital, cultural and informational gaps and also the use of energy through distributed generation, in particular with the inclusion and reinforcement of the theme of “generation own energy” through Social Justice, which was inserted by Law 14.300/2022 and reinforced in Law 14.620 with the inclusion of Art. 36-A, below:

§ 2 The minimum billable value applicable to SCEE participants ed in the Single Registry for Social Programs of the Federal Government (CadÚnico), established by Law No. 8.742, of December 7, 1993 (Organic Social Assistance Law), must be reduced by minimum 50% (fifty percent) in relation to the minimum billable amount applicable to other equivalent consumers, as per Aneel regulations.” (NR)

- Reduction in electricity costs for individuals and legal entities.
- Generation of clean, renewable and sustainable energy;
- No generation of greenhouse gases or noise;
- Simple environmental process.
- Reduction of technical losses in transmission and distribution;
- Wide diversification of renewable energies in Brazil;
- Diversification of the Brazilian energy matrix
- Smart Grid;
- Smart Metering;
- Smart Cities, integrating DG into all these concepts.
Distributed generation further reinforces this last pillar, with its cutting-edge technology, semiconductor industry, control software, remote monitoring, (converting energy from various renewable sources, such as solar, biomass, wind, biogas, etc.) with high efficiency, in available, controlled, cheaper and high quality electrical energy.
An undeniable fact is that the decarbonization of the electricity sector is completely related to the introduction and maintenance of renewable energy sources, sustainable electrification, and the encouragement of energy and social justice with the introduction of the theme of the New Law of the Minha Casa Program, Minha Vida – which from now on inaugurates a new Reindustrialization Process in Brazil.
