Urgent request for PL 1292 is filed with the Chamber

More than 300 signatures were collected to request urgency in the processing of the PL that aims to change provisions of Law 14.300

This Thursday (30) in the Chamber of Deputies, the urgent request do PL 1292 / 2023, which aims close any loopholes left by ANEEL (National Electric Energy Agency) after the publication of the Normative Resolution No. 1.059/2023.

“We obtained the urgency of the bill with more than 300 votes from federal deputies, an unprecedented amount that we achieved”, said Hewerton Martins, president of MSL (Movimento Solar Livre).

The executive participated in a live broadcast, held yesterday, with the participation of Marina Meyer Falcão, legal director of INEL (National Institute of Clean Energy), and federal deputy Lafayette de Andrada (Republicanos/MG).

“It is a big step, a fight for this GD (distributed generation) sector, bringing legal security to the segment, rescuing the spirit of 14.300 and showing ANEEL this base text and how it has to be followed so as not to go off track again”, highlighted Marina.

How does the emergency regime work?

According to Andrada, there is a whole procedural dynamic. “We presented the PL, which has a natural process, but we can shorten this process through urgency”.

“And what is the urgency like? It is possible if we can file a request with more than 257 signatures, half of the of the Chamber. In this case, we obtained more than 300 signatures and filed the urgent request. This is the first step,” he reported.

Next Steps

Regarding the next steps, the deputy commented that Arthur Lira, president of the Chamber of Deputies, will submit this request to a vote, which should take place in two weeks.

“Obviously, if there are more than 300 signatures, everything indicates that it will have more than 300 votes and then it will be approved. Once approved, the president of the Chamber is in a position to decide the vote on the project itself at any time”, explained Andrada.

The expectation, according to him, is that in about a month the approval of PL 1292 will take place, “which corrects the resolution of ANEEL. In our understanding, it went off the rails, going beyond what the Law provided for, and this is not the Agency's responsibility.”

“With this project we will correct in the Law itself, as if we were deg it, what the ANEEL have to interpret. Then they will have to make a new adjustment to the resolution, obeying and complying with the of the standard that we are presenting”, concluded Lafayette de Andrada.
